Personuppgiftslagen (1998:204) är en lag som syftar till att skydda
åra personuppgifter. Huvudregeln i personuppgiftslagen är att
samtycke krävs från den som personuppgifterna tillhör för att de ska få
behandlas. Till denna huvudregel finns det dock ett viktigt undantag
som stipulerar att om behandlingen är nödvändig får den utföras utan
samtycke, om exempelvis ändamålet uppfyller ett berättigat intresse
hos den som ämnar behandla uppgiften som väger tyngre än den
enskildas intresse av skydd för den personliga integriteten. När ett
sådant berättigat intresse ställs mot den personliga integriteten blir en
intresseavvägning nödvändig för att avgöra om behandlingen skall
vara tillåten eller ej. Det berättigade intresset som upptar denna
uppsats är det kommersiella intresset, som exempelvis omfattar ett
företags intresse av att behandla personuppgifter för att via direkt
marknadsföring marknadsföra sina produkter.
Således har denna uppsats sökt att fastställa gällande rätt för
intresseavvägningen i personuppgiftslagen gällande det kommersiella
intresset. En granskning av gällande rätt har visat på att det utan
samtycke är tillåtet efter en intresseavvägning att använda
personuppgifter för direkt marknadsföring.
Abstract
The data protection act (1998:204) is a law whose purpose is to
safeguard our personal data. The main rule of the data protection act is
that consent is required from the one the personal data belongs to for
handling of them to be allowed. There is however an important
exception to this main rule, which stipulates that if the handling is
necessary it may be carried out without consent, if for example the
purpose of the handling fulfils a legitimate interest with the one
intending to handle the personal data that weighs heavier than the
individual??s interest of protection against invasion of privacy. When
such a legitimate interest is put up against protection against invasion
of privacy a weighing of interests becomes necessary. The legitimate
interest of focus in this essay is the commercial interest, which for
example includes a company??s interest of handling personal data to
market its products via direct marketing.
